AI Right to Erasure: How to Delete Your Chat Data

AI right to erasure cover with a bold poster style title on a green background

AI right to erasure is the question of how you get your personal data deleted from an AI service. Under the European GDPR, people have a right to ask a company to erase personal data in certain situations, and that right applies to chat histories, uploaded files and account data held by an AI assistant as much as to any other service. In practice the answer has several layers: what you can delete yourself, what you can ask a provider to delete, what sits in backups and what cannot easily be removed from a trained model.

This guide explains the right in plain words, shows how to delete your data from AI tools step by step, lists what to ask a provider and describes the limits of deletion. It is general information, not legal advice, and it is written for individuals and small businesses who use AI assistants.

What the AI right to erasure means

The right to erasure, often called the right to be forgotten, is set out in Article 17 of the GDPR. It lets a person ask the organisation that holds their personal data, called the controller, to delete it without undue delay when certain conditions apply. Typical conditions include: the data is no longer needed for the purpose it was collected for, you withdraw your consent and there is no other legal basis, you object successfully to the processing, or the data was processed unlawfully. The overview of the right to be forgotten explains the background.

The right is not absolute. The controller may refuse where it needs to keep data to comply with a legal obligation, to establish or defend legal claims, or for certain public-interest or freedom-of-expression reasons. When a request is refused, the provider should tell you why and how to complain to a data protection authority. The deadline for answering is normally one month, which can be extended in complex cases; see Article 12 for the rules on how requests are handled.

What personal data an AI assistant holds

When you use an assistant, several kinds of data may exist. Knowing them helps you ask for the right deletion.

Data type Examples Who can usually delete it
Account data E-mail, name, sign-in method, plan, billing records You can close the account; billing records may be kept for tax law
Chat history Your prompts and the answers You, in the product, or on request
Uploaded files PDFs, documents, images, code You, in the product, or on request
Memory and projects Saved facts, project instructions You, in the product settings
Shared links and exports Links to chats, downloaded copies You must revoke links and delete downloads yourself
Logs and backups Technical logs, security records, backup copies The provider, on its retention schedule
Third-party copies Connected apps, screenshots, copied text You and the other parties

The last row is the one people forget. If you pasted a chat into a document, sent a screenshot or connected another service, deleting the original does not remove those copies. Search your downloads folder, shared documents and message history for exported chats and screenshots, and remove those copies as well.

Step by step: delete your AI data

  1. Decide the scope. Do you want to delete one chat, all chats, uploaded files, memory or the whole account? Write it down.
  2. Export what you want to keep. Download your history before deleting, if you need it. Many tools offer an export; the right to data portability exists for a reason.
  3. Delete in the product. Remove individual chats, files, projects and saved memory in the app settings. Check that shared links stop working.
  4. Check connected services. Disconnect cloud drives, mail and code repositories that you linked, and remove access tokens.
  5. Ask for the rest. If data remains that you cannot delete yourself, send a written request to the provider’s privacy contact and cite the right to erasure.
  6. Keep proof. Save the request, the date and the reply. If the answer is late or unsatisfactory, you can complain to your data protection authority.

Closing an account usually removes or anonymises most personal data after a short period, but providers may keep some records where the law requires it, for example invoices. Read the privacy policy to see retention periods. Our article on AI chat history retention explains why providers keep logs and for how long.

How to word a deletion request

A clear request gets a faster answer. Use the contact address named in the privacy policy, state who you are, give the e-mail address of the account and say exactly what you want deleted. Cite the right, keep the tone factual and ask for confirmation.

Subject: Erasure request under Article 17 GDPR

Hello,
I ask you to erase the personal data linked to my account
[email protected], including chat history, uploaded files, saved
memory and account data, and to confirm when this is done.
Please also tell me whether any data must be kept for legal reasons,
which data and for how long, and whether backups are affected.
Kind regards,
Anna Berg

Providers may ask you to verify your identity, which protects you from someone else deleting your data. If you run a business and a customer asks you to delete data you hold in an AI tool, you have the same duty in reverse; our guide to handling data subject requests with AI describes the process.

What deletion cannot undo

Deleting your chats removes them from the product, but it has limits. Data may remain in backups until they rotate out. Aggregated statistics that no longer identify you may be kept. Text that you already shared with others stays with them. And if your data was used to train a model before you deleted it, removing its influence from the trained model is technically hard. Researchers work on methods known as machine unlearning, but there is no simple button today.

This is why the best protection is to avoid putting data into an assistant in the first place. If a provider states that it does not use your chats and files for training, the question matters less, but you still need to read the terms to be sure. Our guide to the training data opt-out shows how to check and use these settings. Before you paste anything personal, remember the basics in what not to share with AI.

Why a record of your request matters

Keep a simple log: the date you sent the request, the address you used, what you asked for and what the provider answered. If the provider replies that some data must be kept, note which data and the reason given. This record helps if you need to follow up, and it helps a data protection authority if you complain. It also protects you from a common mistake, which is assuming that a request was completed when it was only acknowledged.

If personal data has already leaked

Erasure is a clean-up tool, not an incident response plan. If you suspect that sensitive data was exposed, for example through a public shared link or a wrongly addressed export, act quickly: remove access, change passwords and keys, document what was exposed and notify the people or authorities involved when the law requires it. For businesses, the GDPR sets strict timelines for reporting certain breaches. Our article on what to do after an AI data leak gives a checklist.

Work, school and shared accounts

If you use an AI assistant through an employer, a school or a shared team plan, the picture changes. The organisation may be the controller of the data, and it decides retention and deletion. You may still have rights regarding your personal data, but the request goes to the organisation, not necessarily to the tool’s vendor. Ask your data protection officer or administrator who holds the data and what the policy says.

Teams should also decide what happens when someone leaves. Chats and projects created on a company account can contain customer information, contracts and internal plans. Set a rule to export what the company needs, transfer ownership of shared projects and delete the rest according to your retention schedule. A short offboarding checklist prevents both accidental loss and accidental over-retention. Our company AI use policy guide includes a section on accounts and retention that you can adapt.

Parents and guardians have a special role for children’s accounts. Data about minors deserves extra care, and deletion requests are often easier when made by the person with parental responsibility. Teach young users the habit early: do not share names, schools, addresses or photos in prompts, and delete chats that contain anything personal.

Practical habits that make erasure easier

  • Keep personal data out of prompts unless you need it; use placeholders and merge details later.
  • Use separate projects for sensitive work, so you can delete them in one step.
  • Review your chat list monthly and delete what you no longer need.
  • Revoke shared links when the reason for sharing has passed.
  • Keep a short record of the tools you use and where your data sits.
  • For work accounts, agree a company rule on retention, so that deletion is routine and not a crisis.

The guide to EU-hosted AI and GDPR explains the other rights that sit next to erasure, such as access, correction and portability, and what to ask a provider about where data is processed.

Deleting your data in Ask Mio

With Mio, chats and files are yours: you can export or delete them at any time, and they are not used to train models. Memory and projects are visible and controlled by you, so you can remove what Mio has saved. If you need something deleted that you cannot remove yourself, or you have a question about your data, use the contact page, and read the privacy policy for the details of what is kept and why.

The free plan keeps a limited history, and paid plans keep it without a time limit, so deleting on your own schedule matters most on paid plans. Compare the plans on the pricing page.

Frequently Asked Questions

Do I have a right to delete my AI chat history?

Under the GDPR you can ask a provider to erase personal data in the situations listed in Article 17, and many products also let you delete chats yourself. Some data may be kept where the law requires it. Check the product settings first and the privacy policy for the rest.

How long does a provider have to respond?

Normally one month from receiving the request, with a possible extension in complex cases. The provider may ask you to verify your identity. If you do not get a reply or the reply is unsatisfactory, you can complain to your national data protection authority.

Does deleting my chats remove my data from the AI model?

Deleting chats removes them from the product, but it cannot easily remove their influence from a model that was already trained on them. That is why it matters whether a provider trains on your data at all. Check the terms and use opt-outs where they exist.

What happens to backups after I delete something?

Backups usually keep copies for a limited time and then expire on a schedule. The provider should be able to tell you the period. Ask in your request whether backups are affected and how long they remain, and keep the answer with your records.

Can I delete data I shared through a link or an export?

Only partly. You can revoke a shared link and delete files you downloaded, but you cannot delete copies that other people saved. Before you share a chat, assume that anyone with access might keep it, and remove sensitive details first.

Can Mio delete my data on request?

Yes. You can export or delete your chats and files at any time, and manage memory and projects yourself. For anything you cannot remove on your own, contact the team through the contact page and refer to your account e-mail so that the request can be matched.

The Bottom Line

AI right to erasure gives you real tools, but they work best when you combine them: delete in the product, revoke shared links, disconnect services, send a written request for the rest and avoid feeding sensitive data into any assistant in the first place. Keep records of what you asked and when. Start with the free plan and compare options on the Ask Mio pricing page.
